DSS Device/Satellite Dish Policy
A satellite dish may be installed in the common area of the front yard or back yard of the member’s townhouse as outlined in this Policy. Only one satellite dish may be installed in the common area of a member’s townhouse as outlined in this Policy. DSS devices are not allowed in any other common area of the Cooperative.
b. A drawing illustrating the placement of the device must be submitted with your installation application. The drawing must include all relevant dimensions including the landscaping, the size and type of device.
c. All installations must be reviewed and approved by management for proper placement within the following guidelines, prior to the actual installation.
d. An insured professional must install/remove the DSS device in accordance with the requirements and specifications listed in this policy. You may use an installer of your choice or an installer recommended by the Cooperative.
e. Residents cannot install the satellite dish themselves and must have the satellite dish professionally installed with either themselves or their representative present.
f. A copy of the installer’s liability and workers compensation insurance must be attached to your installation application ($500,000 minimum).
g. Landscaping, such as bushes, shrubs, trees, cannot be altered or removed without the prior approval of the office.
h. The satellite dish cannot exceed one meter in diameter. A satellite dish larger than one meter (39.37”) measured across its widest part cannot be installed in the Cooperative.
i. The satellite dish may not be installed in any way that damages the common area, including the unit or building. No holes may be drilled in railings, windows, or exterior walls during the installation, use, or removal of satellite dishes. Wiring satellite dishes in this way harms building weatherproofing, promotes insect infestation, and poses a risk to electrical wiring, water pipes, etc.
j. Cable entry points to the building must be obtained through mortar joints at the basement level or through existing cable entry access at the same level. Cables must not be run through any portion of basement windows, siding, shutters, air conditioner box, roof, or any other windows.
k. Cable access must be properly sealed to prevent moisture or insects from permeating
and entering the building.
l. Cable wires in the unit must be fished up through walls.
m. The member must have insurance to cover any damage or liability associated with the dish. A copy of the insurance policy will be kept in the member’s file at the management office.
n. The member is responsible for the removal or extermination of insects or animals
involving the dish or covering.

II.
Regulations for front and back yard DSS
Device Installation:
a. The dish must be
confined to an area that is no further out than four feet from the
building or to the edge of the porch (this distance does not include the porch steps).
b. No portion of the dish or cover will extend past the edge of the porch and must
provide a safe clearance for lawn mowers.
c. The upper most portion of the device in the yards must: a) be below the bottom
height of the living room window and b) not exceed 2-feet above grade.
d. With prior approval from the management office, the member is responsible to
remove the bush or shrub (including root system) in front of their townhouse.
e. The area must be landscaped according to Cooperative standards and visually
appealing.
f. The dish must be visually screened with an acceptable satellite dish rock cover at the
member’s expense. This cover must be maintained in good condition without
cracks, holes, dents, discoloring, or any other manner that would create an eyesore
or safety hazard.
g. All cables connected to the dish must be buried a minimum of 6 inches underground.
III. Regulations for operation & use
of a DSS Device
a. Management
shall place a copy of the approved permit, photographs, and inspection form in the member’s file. These items shall become a permanent part of
that file.
b. The Cooperative is not responsible for any damage to the dish or dish cover as a result of lawn maintenance (i.e., mowing), snow plowing or removal efforts, snow removal from the roof, and all forms of building maintenance. The Cooperative will only be responsible for necessary repairs resulting solely from negligent damage by the Cooperative staff during a non-emergency situation where neither repairs nor access was necessary.
c. This installation shall be subject to the Property Improvement Policy, Gardening Policy, and any other current or future policy of the Cooperative. The current member and any future members upon acceptance of installation are obligated to maintain the appearance, safeness, and soundness of the installation. The cost of so doing and the cost of any repairs will be at the member’s expense. This includes any repairs that might result from the Cooperative’s or other contractors that need to access any part of the installation.
d. If the condition of the installation has deteriorated to a level that is unacceptable to the
Cooperative, the member must either bring the condition up to acceptable standards or
remove the installation and return the area to its original condition. If the member fails
to do so the Cooperative will perform any necessary repairs and/or removal at the
member’s expense.
University Townhouses Cooperative reserves the right
to require changes to the installation based on changes in technology, signal
reception, and Cooperative policy. This
shall be the sole financial responsibility of the current member or the
outgoing member if the installation is not accepted.

Members Acknowledgement:
I have read the above
policy and agree to comply with its terms.
I accept sole liability for, and indemnify the Cooperative against, any
claim for damages or otherwise arising out of the installation or existence of
the satellite dish and its cover in the area encompassed by or on which those
improvements exist.

** The Federal Communications Commission (FCC) Regulations allows a resident of a multiple dwelling unit building to install a satellite dish/video antenna in an area designated for their exclusive use. “Exclusive use” means an area of the property that only you, and persons you permit, may enter and use to the exclusion of other residents. For example, the inside of your townhouse, your deck or patio that only you can use. A fence, deck, or patio “with a dimension of 12-16 feet in length extending out from the rear of the building and a width of at least 10 feet not to exceed the width of the townhouse denotes exclusive use within the Cooperative. Fences must have a height of six (6) feet. Corner townhouses without sufficient space may request an exception to the Policy.” Therefore, members of the Cooperative may install video antennae within the confines of their fence, deck, or patio. When the fence, deck, or patio is removed so is the exclusive use of the area and it reverts back to a common area. According to FCC Regulations, satellite dishes may not be installed in common areas, such as the roof, walkways, trees, front yard, or the exterior walls of the building.
The installation and use of a satellite dish in an exclusive use area must conform to FCC Regulations, Ann Arbor City Code, the Regulations for Fences, Decks, and Patios, and any other applicable polices of the Cooperative.
